Garage Tenancy Agreement
Conditions of use
1. The Parties (“the Parties”)
1.1 MAGNA HOUSING ASSOCIATION LIMITED (“the Association”) whose registered office is at Hollands House Poundbury Road Dorchester Dorset DT1 1SW
1.2 THE TENANT (“the Tenant”)
1.3 Name
1.4 Of house address.
2. The Tenancy (“the Garage Tenancy Agreement”)
2.1 The Association give the Tenant permission to use the Garage number
No in garage from the Start Date until such time as the tenancy is Terminated as provided below
3. The Start Date (“the Start Date”)
3.1 The Tenancy begins on the date day of month year.
4. The Rent (“the Rent”)
4.1 The Rent is payable IN ADVANCE fortnightly on a Monday and it may be paid at any Post Office alternatively it may be paid by Direct Debit in advance
4.2 The Association may vary the amount of Rent payable by giving the Tenant TWO WEEKS NOTICE in writing
4.3 The Rent of the Garage is £rent every two weeks in advance plus VAT of £cost making £total
4.4 sum total due every two weeks in advance.
5. The Association’s Obligations
5.1 The Association and as Landlord agrees to allow the Tenant to use the Garage and to leave all necessary access to and egress from the Garage at all times in connection with its intended use so long as the Tenant does not breach any of the Obligations set out in the Tenancy
5.2 To maintain the structure and exterior of the Garage in good repair
6. The Tenant’s Obligations
6.1 The Tenant agrees to pay the Association the Rent as detailed above or any variation properly notified as above
6.2 To report any repairs or damage promptly and any damage or repairs not attributable to fair wear and tear will be charged to the Tenant by the Association
6.3 To allow the Association and its representative access at all times for any purpose connected with its capacity as a Housing Association
6.4 To ensure that any activities carried out in the Garage OR its vicinity does not cause a nuisance to nearby tenants or residents
6.5 To keep the Garage in a clean and tidy condition and in no worse state of condition than at the date of this Garage Tenancy Agreement
6.6 Not to assign this Tenancy or sublet or otherwise part with or share possession of the Garage
6.7 Not to carry out any alterations or additions to the structure of the Garage
6.8 Not to obstruct the entrance to any of the roads or access ways leading to the Garage
6.9 NOT TO STORE more than TWO gallons of petrol (other than that in the petrol tank of the vehicle) any containers must be clearly marked PETROLEUM SPIRIT and they must be of the kind suitable for the storage of such spirit and the Tenant must NOT keep any other highly inflammable or explosive liquid gas or any other hazardous material or substances in the Garage
6.10 Not to display or allow any advertisement notice or nameplate to be displayed in the Garage or to use the Garage for any trade or business or commercial purpose whatsoever
6.11 For the avoidance of doubt the garage may be used to store items other than motor vehicles but the storage of any item is at risk of the tenant and the Association shall not be liable for the loss of damage or theft of any item howsoever caused.
7. Termination
7.1 The Tenancy will continue until terminated by either the Association or the Tenant and either Party must give TWO WEEKS WRITTEN NOTICE expiring on the SUNDAY and Rent must be paid up to the date of Termination and the keys returned by 12 NOON the following day to any of the Association’s offices and failure to return the key by the time required will result in a cost of one weeks rent being charged to the Tenant
7.2 The Tenant must remove ALL goods and personal possessions from the Garage by the date of Termination given by either Party
7.3 The Association reserves the right to dispose of any property which remains in the Garage after the Tenancy is terminated and any costs so arising may be recharged to the former Tenant
Any BREACH of this Tenancy may result in TWO WEEKS NOTICE OF TERMINATION being served and/or the recharging of any costs incurred by the Association as a result of the breach and your attention is drawn to the REQUIREMENT that rent is paid TWO WEEKS IN ADVANCE at all times
The Tenant hereby accepts the Tenancy of the Garage on the terms set out by the Association as provided above
